FTC & UK Compliance Guide: Disclosures That Protect You

Everything you need to know about affiliate disclosure compliance in the US and UK: FTC endorsement guidelines, CAP Code rules, ASA expectations, cookie consent, and ready-to-use disclosure templates.

Why This Matters: Real Penalties Are Real
The FTC has issued fines up to $50 million for undisclosed endorsements. The UK ASA has banned Google ads from non-compliant publishers. Affiliate programme TOS violations can result in instant commission clawback and permanent bans.

US: FTC Endorsement Guidelines (§255.4)

The Federal Trade Commission's Endorsement Guides (16 CFR §255.4) require that any "material connection" between an advertiser and endorser be disclosed. In affiliate marketing, this means the commission relationship must be clear before the audience clicks.

Approved Disclosure Language

Recommended Footer Disclosure (Paste-Ready)
Disclosure: Some links on this page are affiliate links. We may earn a commission if you make a purchase through these links, at no additional cost to you. We only recommend products we've researched.

The key requirement is clarity and proximity. The disclosure must appear before or adjacent to the first affiliate link. Disclaimers buried in privacy policies do not satisfy FTC requirements.

Platform-Specific Guidance

UK: CAP Code & ASA Rules

The UK Advertising Standards Authority (ASA) enforces the CAP Code for identifiable commercial communication including affiliate links.
